Avandia lawsuits are personal injury cases in which patients injured after taking the Avandia prescription medication seek compensation from GlaxoSmithKline, the maker of Avandia. Whether filed as an individual claim or an Avandia class action case, Avandia lawsuits can win settlements for affected patients by proving that:
- A patient's injuries were caused by taking Avandia.
- GlaxoSmithKline knew about severe Avandia side effects and failed to disclose them to the FDA and the general public.
Avandia patients who develop one (or more) of the following conditions will likely have a viable legal claim and will be entitled to compensation for their injuries:
- congestive heart failure
- heart attack
- liver toxicity
- severe allergic reaction
Families of patients who have died due to Avandia complications will also be entitled to monetary settlements for their loss. In such instances of Avandia death, it's typically a better idea to file an individual lawsuit, rather than join a class action case.
How to Start an Avandia Lawsuit
The first step to starting an Avandia lawsuit is to meet with a personal injury lawyer for an initial consultation. During this meeting, injured Avandia patients can:
- Find out if they have a provable case against GlaxoSmithKline.
- Learn about the process of building and winning Avandia lawsuits.
- Get information about proceedings of and settlements in cases similar to their own.
- Determine whether filing an individual case or joining a class action suit is best for their circumstances.
As an added incentive for prospective plaintiffs to stand up for their legal rights, most Avandia lawyers don't charge for these initial consultations.
Benefits of Working with Avandia Litigation Lawyers
Once patients learn they have a legal claim and decide to pursue an Avandia lawsuit, it's a good idea to find an experienced personal injury lawyer to represent them in a professional manner.
Studies indicate that plaintiffs are far more likely to win larger settlements if they work with an experienced lawyer, as these professionals can:
- Find credible experts to testify in legal proceedings and help prove the patient's case.
- Effectively negotiate with corporate lawyers for GlaxoSmithKline.
- Research similar cases so that they are sure to get the proper compensation for the severity and type of a patient's injuries.
To further encourage patients to start their cases, most Avandia lawyers work on contingency – meaning that plaintiffs won't have to pay for legal services until (or, in some cases, unless) they win a settlement.

More About Avandia Legal History & Help
Avandia has been an enormous financial success for pharmaceutical manufacturer GlaxoSmithKline (GSK). The antidiabetic drug, based on the generic compound rosiglitazone, was introduced to the market in 1999. GSK followed with two additional rosiglitazone drugs, Avandamet and Avandaryl, also meant for the treatment of diabetes. All of these drugs have been demonstrated to be the cause of serious and sometimes fatal side effects. Since 2003 the FDA has been issuing warnings about these drugs. GSK has revised the warnings for them several times and sent notifications of potential harmful effects to every physician in the country on several occasions.
Heart attacks, strokes, and congestive heart failure related to the use of Avandia have resulted in thousands of lawsuits filed against the manufacturer. Other side effects that have resulted in Avandia lawsuits include liver damage, loss of vision and the occurrence of bone fractures in the hands, upper arms and feet. Avandia attorneys, also representing Avandamet and Avandaryl users, have filed actions in both state and federal courts, as single actions and as class action suits. Avandia wrongful death suits have been filed by families who have lost someone to an Avandia related fatality.
The acceleration of lawsuits has followed the expansion of use for these medications which has been substantial. In 2006 Avandia sales in the United States were $2.2 billion. As the three drugs have grown in popularity so have the reports of adverse side effects. In 2006, 2007, 2009 and 2010 there have been clinical studies and “meta-analyses? of multiple studies that have established the relationship of these medications to serious health problems and fatalities. Avandia attorneys have filed thousand of suits over these side effects:
• Heart attack
• Congestive heart failure
• Bone fractures
• Live Damage
• Macular edema
• Heart damage
• Pulmonary hypertension
• Pulmonary embolism
Avandia Legal Settlements and Claims
Since Avandia has been on the market GlaxoSmithKline has been sued over 13,000 times because of adverse effects that the rosiglitazone drugs have had on diabetic patients. One of the plaintiffs is Santa Clara County in California, which claims to have spent $2 million on Avandia for use at its public hospitals and seeks triple damages. The company settled an initial round of these cases in May of 2010, agreeing to pay $60 million to close out 700 cases. In July of 2010 another 10,000 suits were settled at a cost to GlaxoSmithKline of $460 million.
Most states have a statute of limitations on product liability suits and wrongful death suits. Both types of actions have been features of Avandia litigation since many people using Avandia suffered fatal heart attacks. Generally plaintiffs in these cases are limited to a few years after the wrong has occurred or after the date of death to file these actions.
