Avandia has been an enormous financial success for pharmaceutical manufacturer GlaxoSmithKline (GSK).  The antidiabetic drug, based on the generic compound rosiglitazone, was introduced to the market in 1999.  GSK followed with two additional rosiglitazone drugs, Avandamet and Avandaryl, also meant for the treatment of diabetes.  All of these drugs have been demonstrated to be the cause of serious and sometimes fatal side effects.  Since 2003 the FDA has been issuing warnings about these drugs.  GSK has revised the warnings for them several times and sent notifications of potential harmful effects to every physician in the country on several occasions.

Heart attacks, strokes, and congestive heart failure related to the use of Avandia have resulted in thousands of lawsuits filed against the manufacturer.  Other side effects that have resulted in Avandia lawsuits include liver damage, loss of vision and the occurrence of bone fractures in the hands, upper arms and feet.  Avandia attorneys, also representing Avandamet and Avandaryl users, have filed actions in both state and federal courts, as single actions and as class action suits.  Avandia wrongful death suits have been filed by families who have lost someone to an Avandia related fatality.

Since Avandia has been on the market GlaxoSmithKline has been sued over 13,000 times because of adverse effects that the rosiglitazone drugs have had on diabetic patients.  One of the plaintiffs is Santa Clara County in California, which claims to have spent $2 million on Avandia for use at its public hospitals and seeks triple damages.  The company settled an initial round of these cases in May of 2010, agreeing to pay $60 million to close out 700 cases.  In July of 2010 another 10,000 suits were settled at a cost to GlaxoSmithKline of $460 million. 

Most states have a statute of limitations on product liability suits and wrongful death suits.  Both types of actions have been features of Avandia litigation since many people using Avandia suffered fatal heart attacks.  Generally plaintiffs in these cases are limited to a few years after the wrong has occurred or after the date of death to file these actions.
