Bayer announced on August 8, 2001 that it was issuing a Baycol recall. In what many people felt was a delayed response to adverse effects, Bayer finally responded to the 100 deaths linked to Baycol, in addition development of the rare condition rhabdomyolysis, by making the voluntary move for a Baycol recall. Bayer had continued to maintain the safety and efficacy of Baycol, however the Baycol recall prompted the now over 10,000 Baycol lawsuits filed.
By the time the Baycol recall was issued there were 700,000 Americans using the drug. Introduced in the U.S. in 1997, Baycol was like other statins in that rhabdomyolysis was a rare but potentially deadly adverse effect that could occur, but the Baycol recall was made primarily because of the increased risk that Baycol patients suffered rhabdomyolysis over other statins. The rhabdomyolysis suffered in Baycol patients was especially dangerous because the increased risk of it resulting in death over other statins.
So far, 888 Baycol lawsuits have been settled and Bayer is waiting to see if some Baycol lawsuits develop into a class action lawsuit.
