A Byetta® Lawsuit in California

For example, a California-based Byetta® lawsuit was filed in August 2008 by a Byetta® user who was hospitalized in late 2007 after developing pancreatitis, a severe infection of the pancreas that can cause internal bleeding and death.  The plaintiff claims Byetta® caused the condition.

Over Thirty Reports of Byetta®-Related Injuries

In fact, by August 2008, the FDA had received more than 30 reports of serious adverse medical events among Byetta® users. In response, the FDA has required the strengthening of Byetta's® warning label regarding its pancreatitis risk along with other Byetta® Injuries.

Other Harmful Byetta® Side Effects

In addition to an increased risk of developing pancreatitis, Byetta® users have reported to have experienced other serious Byetta® side effects as well. All individuals who suffer any one of Byetta®’s side effects may be eligible to file a Byetta® lawsuit. Some of the other side effects may include: 

  • Nausea, vomiting
  • Debilitating abdominal pain
  • Diarrhea
  • Dizziness, headache

Allegations in the California Byetta® Lawsuit

The plaintiff's attorneys in the California Byetta® lawsuit contend that "It is pretty obvious that the label change in 2007 was not adequate," and that the makers of Byetta® (Amylin Pharmaceuticals and Eli Lilly Co.) "failed to adequately warn prescribing physicians of the risk of pancreatitis, of measures needed to properly assess the appropriateness of prescribing the drug to certain categories of patients, and of measures doctors and patients could and should take to minimize the risk." 

How Much the Manufacturers Knew, and When

Byetta® is the main product of San Diego-based Amylin Pharmaceuticals; Eli Lilly is a well-established pharmaceutical industry giant. The two companies are alleged to have possessed clinical data that justified a stronger warning label about pancreatitis compare to the warning language that Amylin eventually agreed to with the FDA.
