Celebrex Litigation

Celebrex litigation is currently underway in the United States and other countries worldwide. In the United States, Celebrex litigation is being pursued in the areas of tort, or personal injury, law and federal securities law. Celebrex litigation is a response to clinical studies that have indicated that patients who are take higher doses of Celebrex may be up to three and a half times more likely to suffer heart attack or stroke than the general population.

Pfizer is the maker of Celebrex and the defendant in Celebrex litigation. The pharmaceutical giant's announcement of serious Celebrex side effects in mid-December 2004 has caused a fifty six percent drop in Celebrex sales and a potential wipe out of about $25 billion of Pfizer's market value. The financial and marketing prospects for Celebrex have been further hindered by a recent FDA request. In mid-January 2005, the FDA ordered Pfizer to halt all commercial marketing of Celebrex pending further clinical trial findings, a move that Pfizer made in December in anticipation of this request.

The FDA's letter included statements that Pfizer has overstated the benefits and underestimated the risks of Celebrex use. This statement is the basis for many charges brought against Pfizer through Celebrex litigation. In early January 2005, Celebrex litigation was instigated through a class action lawsuit filed in Connecticut. This Celebrex litigation suit, filed on behalf of Pfizer stockholders, alleges that Pfizer is in violation of federal securities laws because they issued false and misleading statements about the safety of Celebrex. This Celebrex litigation has brought up the fact that Pfizer has repeatedly announced that Celebrex use does not pose increased cardiovascular risks to patients.

Arguably more important than financial losses, is the loss of, or damage to, life that has been caused by the use of this COX-2 selective prescription painkiller. Celebrex litigation through the tort system allows those who have been injured by Celebrex use to seek compensation for their losses including medical expenses, loss of income, disability, and psychological suffering.

In late December 2004, the first tort class action Celebrex litigation was pursued in the United States. This class action lawsuit was filed against Pfizer on behalf of all Americans who have taken Celebrex. Through this Celebrex litigation, the plaintiffs seek relief for damages caused by Celebrex injuries and medical exams for all Celebrex users to ensure early detection and treatment of Celebrex side effects.

Official federal investigation of Celebrex safety is underway. The FDA will hold a three day hearing to discuss Celebrex side effects in February 2005. The outcome of this hearing will no doubt have a major impact on the future of this medication and the course of Celebrex litigation.
