Many Duragesic® patch lawsuits have been initiated over the past decade, which is understandable in light of the safety record of this product.   • A Chicago jury awarded over $16 million to the family of a woman who died in 2004 due to a leaking Duragesic® pain patch.
  • A Florida jury returned a $13 million verdict in the case of a woman who died in 2002 after the post-back surgery use of Duragesic® patches.

Confidential Settlements following Duragesic® Patch Lawsuits

Other Duragesic® patch lawsuits have resulted in similar — if somewhat smaller — court awards and settlements. In cases that are settled, it is often a condition of the settlement that the details of the settlement are not made available to the public (as is the case with court awards). It is thus difficult to estimate the number of Duragesic® patch lawsuits that have been settled privately between the victims (or their surviving families) and the defendant drug makers such as Johnson & Johnson, PriCara and Sandoz.

Second-Highest Number of Suspect Drug Deaths

However, an idea of how dangerous Duragesic® patches are can be deduced from the following information. The Wake Forest University School of Medicine's Institute for Safe Medication Practices and Division of Public Health Sciences conducted a study in 2007 of the FDA's Adverse Events Reporting System.

They found that fentanyl — the active ingredient in Duragesic® patches — was involved in at least 3,500 drug deaths during the prior eight years. These data made fentanyl the second-most dangerous drug used in the U.S. (with the second-highest number of suspect drug deaths).
