A lawsuit has been filed in the state of California by a man from Virginia who claims he has been injured by the diabetes drug, Byetta.
Although the risks of the medication were recently revealed, this suit marks the first against Amylin Pharmaceuticals, the manufacturers of the drug, for injuries linked to the medication.
Patient Suffers from Side Effects
Victor Deleon has filed the lawsuit in San Diego Superior Court, since Amylin is based in the city of San Diego.
Eli Lily and Company is also named in the suit since they are the co-maker of Byetta.
Deleon claims the manufacturer’s failed to properly test the medication before marketing it for use for those with diabetes.
Deleon states that after taking Byetta his health deteriorated and he was forced to be hospitalized due the drug’s side effects.
Recent Problems with Byetta
The FDA recently announced that they have received six reports of patients developing pancreatitis after taking Byetta.
Two of the six patients reportedly died from the severe side effects and the FDA is currently fighting for stronger labels to be put on the drug.
