Denver Court Upholds Ephedra Ban

A ruling handed down by the 10 th U.S. Court of Appeals upheld the Food and Drug Administration's ban on the once popular dietary supplement ephedra, reversing an earlier decision made by a federal judge in Utah.

The FDA banned ephedra in 2004 based on a risk-benefit analysis involving exhaustive research and extensive scientific data. The agency concluded that ephedra poses an "unreasonable risk of illness or injury," particularly to those suffering from high blood pressure and heart disease.

In April 2005, a Salt Lake City federal judge ruled in favor of lifting the FDA's ephedra ban. This recent ruling, however, makes the marketing of ephedra in the U.S. illegal and subject to disciplinary action by the FDA.

According to the agency, no ephedrine-containing dietary supplements are safe - regardless of dosage. Ephedra has been linked to more than 100 deaths and is currently the subject numerous lawsuits.
