Drug Manufacturer Sued Over Fosamax

-July 26, 2007

The first lawsuit has been filed against Merck & Co. in Canada due to the severe side effects of the drug Fosamax.

The drug manufacturers are currently defending more than 27,000 lawsuits against them by users of Vioxx, a once popular painkiller.

Fosamax Causes Severe Health Complications

The lawsuit against Merck & Co. alleges that the manufacturers failed to warn Canadian consumers of the jawbone damage that could be caused by Fosamax.

Fosamax has been said to cause bone loss and deterioration around the patient's jaw.

Several lawsuits have already been filed in the United States against Merck as a result of the risks associated with the drug, which was approved in 1995 to help treat osteoporosis.

Woman Files First Canadian Suit

When Fiona Peters was prescribed Fosamax, she took the drug for three years; unaware of the detrimental effects the medication was having on her jawbone.

In 2004, Peters was diagnosed with osteonecrosis of the jaw, claims the complaint.

“She has suffered from extreme physical pain resulting from the breakdown of her lower jaw bone and will require further treatment and surgeries,” states her attorney.
