Plavix Lawsuit Cites Deceptive Marketing Practices

The first Plavix lawsuit filed by a patient injured by the popular blood-thinning drug accuses Bristol-Myers Squibb and Sanofi-Aventis, the drug's makers, of intentionally withholding important safety information.

Dorothy Hall was prescribed Plavix to ward off a heart attack or stroke. According to the lawsuit, she suffered two strokes both of which required medical attention as a result of taking Plavix.

Concealing the Risks

The lawsuit claims that the drug makers concealed the risks associated with Plavix and that Hall would never have taken the drug had she known of its dangers, which include an increased risk of stroke, heart attack, internal bleeding, and potentially death.

BMS and Sanofi repeatedly thwarted the law and their duty to inform the public about the drug they were promoting for profit. They misinformed physicians about who should be given Plavix and about the proper applications for the drug, causing people to die and be seriously injured as a result, said attorney Nancy Hersh.

The makers of the drug marketed Plavix as a safe, effective alternative to low-dose aspirin therapy used for preventing heart attacks, strokes, and other cardiac events. Consequently, doctors who were unaware of the serious risks began to prescribe the drug either alone or in conjunction with aspiring more liberally.

The Risks Revealed

Earlier this year, the New England Journal of Medicine published a study showing that Plavix could actually cause the very problems it was intended to prevent.

Although doctors believe the combination of Plavix and aspirin should reduce the risk of a second heart attack, the combination not only does not help, but it nearly doubles the risk of death, heart attack, or stroke in people with no history of heart disease, the study said.

The personal injury lawsuit was filed last month on behalf of Hall and her husband Thomas and seeks unspecified damages.
