Vioxx class action lawsuit filed in Arizona

Vioxx was pulled from the market in September by manufacturer Merck & Co. after studies indicated that patients taking the arthritis painkiller for 18 months or longer had double the risk of heart attack and stroke.


Edward Wright, a resident of Phoenix, suffered a heart attack that he believes resulted from his use of Vioxx. Wright is now the lead claimant in an Arizona class action suit against Merck. Attorneys representing Wright said in a statement that the Vioxx suit was the first class action filed against Merck in Arizona.

Once the court certifies the Vioxx suit, any Arizona resident who purchased Vioxx over the past four years will be represented by it. Wright said he purchased Vioxx without knowing the health risks associated with the drug. The complaint claims Merck withheld information about Vioxx’s health risks and violated Arizona’s consumer fraud act, unjustly profiting from its conduct.
