The US District Judge responsible for handling federal Vioxx litigation, Eldon Fallon, has set the dates for the next five Vioxx cases to be heard on the federal level. The next Vioxx case involves a New Orleans man who suffered a non-fatal heart attack while taking Vioxx. This Vioxx case will begin on June 12, 2006.
Ellis Diaz began taking Vioxx in September 2001 and suffered his heart attack in 2004. Through his federal Vioxx lawsuit, Mr. Diaz is seeking $100,000 in damages. His attorney previously requested a postponement of his trial, but Fallon denied this request.
Fallon has also set the date for the next four federal Vioxx cases that will go to trial. Following these cases, Fallon hopes to work out a settlement with attorneys.
