Closing Arguments Set in Fifth Vioxx Case

With two wins and two losses for New Jersey-based pharmaceutical company Merck, a Texas jury will hear closing arguments and determine Merck's liability this week in the fifth Vioxx case to go to trial. This case involves 71-year-old Leonel Garza, who died of a heart attack after taking Vioxx for one month. His grieving family members are seeking $1 billion in compensatory damages.

Attorneys for Merck argue that Mr. Garza's heart attack was the result of 23 years of heart disease, not the result of Vioxx use. The company also argues that Garza took the drug for only a week prior to his fatal heart attack.

Attorneys for Garza's family allege that he had taken Vioxx for a full month prior to his heart attack. They have also presented evidence indicating that Garza's veins were clear and medical tests performed two weeks prior to his heart attack indicated he had less than a two percent chance of suffering a heart attack within the year.

In this and other Vioxx cases, the plaintiffs have argued that Merck knew of the increased cardiovascular risks posed by Vioxx as early as 2000, yet intentionally concealed this information from the public. In the most recent Vioxx trial, the jury determined that Merck "wantonly and willfully" concealed important safety information from the public regarding the risks of Vioxx cardiovascular complications.
