To be armed with this package, however, by no means translates into an easy win against Merck. Of the five cases gone to trial so far, Merck has been favored in three. Of the two successful Vioxx lawsuits, the plaintiff's attorneys did not have access to this trial package, conducting much of their fact-finding independently. Lawyers will still have to prove that Vioxx caused the injuries their client suffered while taking this once-popular painkiller.
Vioxx plaintiff attorneys welcome the advantages offered by the Vioxx trial package. If this new resource prompts additional Vioxx lawsuits, they hope this will increase pressure on Merck to settle instead of fighting each case individually, as the company has vowed to do. It will also give attorneys fighting for those injured by this defective drug additional arsenal with which to fight Merck in court.
The Vioxx trial package ultimately favors patients and their families who have endured great loss and suffering because of devastating, and perhaps preventable, Vioxx side effects.
