Vioxx Judge Continues Punitive Damages Hearing

Last Friday, New Jersey Superior Court Judge Carol Higbee rejected Mercks request to halt a hearing intended to determine whether Vioxxs maker will have to pay punitive damages in the most recent Vioxx case. Last Wednesday, the court ruled that Merck failed to warn consumers about the risks associated with taking their once-popular painkiller Vioxx.

The plaintiff in this Vioxx case, 77-year-old John Mc Darby, who suffered a heart attack while taking Vioxx, has been awarded $4.5 million in compensatory damages.

The hearing, which will proceed under court order, will determine whether Merck will have to pay punitive damages on top of these compensatory damages. If the jury finds that Merck intentionally and willfully hid Vioxx side effect risks from consumers, the company could be made to pay up to five times the compensatory amount already awarded.

Merck may be ordered to pay up to $22.5 million in punitive damages.
