Legal professionals are reporting that injuries caused by the fourth generation birth control pills, Yaz and Yasmin have given birth to a new mass tort.
What is a Mass Tort?
A mass tort is a civil action that involves multiple plaintiffs and only one (or a few) defendants. In this case, the defendant is Bayer HealthCare Pharmaceuticals, the makers of both Yaz and Yasmin. The numerous plaintiffs are women (and families of women) who have suffered from injuries while taking one of the oral contraceptives.
The lawsuits claim injuries including:
- Heart attack
- Stroke
- Deep vein thrombosis
- Pulmonary embolism
- Gallbladder damage
- Kidney stones
The plaintiffs seek compensation for their losses, which may include:
- Physical pain
- Emotional trauma
- Medical costs
- Loss enjoyment of life activities
- Loss ability to pursue a normal course of employment
- Funeral and burial costs in cases involving death
Fourth Generation Birth Control Pills Carries Highest Risk
Plaintiff’s attorney Dan Gallucci of RodaNast, P.C. reports that he is currently investigating hundreds of cases involving Yaz/ Yasmin injuries. Noting that there are no other forms of birth control, aside from Yaz and Yasmin, that contain a diuretic, Gallucci alleges that the diuretic in these two fourth generation oral contraceptives (drospirenone) may increase the risk of blood clotting among users.
Drospirenone, a novel progestin component found in the two Bayer-produced contraceptives may cause a dangerous increase in potassium levels which can ultimately lead to hyperkalemia or disrupted heart rhythms and a slowed blood flow, which may result in blood clots.
In addition to blood clots, Gallucci said he has some clients who are filing lawsuits against Bayer for damage they incurred to their Gallbladders. He also mentioned that some of these plaintiffs weren’t even of childbearing age, but took the pill for acne.
