Bayer's Baycol problems continue

Baycol hit the U.S. market in 1998 and was an immediate success. Millions of people worldwide switched from using other statin drugs to Baycol, some in part to the lower cost. It was not long before Baycol users began to complain of adverse effects, including very serious conditions like rhabdomyolysis that could lead to death, paralysis, and kidney failure.

Baycol labels were changed to reflect the dangers of mixing Baycol with other drugs but proved to still be an inadequate enough measure. By August 2001, the FDA had received so many reports of rhabdomyolysis occurring among Baycol patients using the drug without any other drug combination to warrant a Baycol recall.

More than 12,000 Baycol lawsuits were filed in response to the Baycol recall. Bayer was facing one of the largest product liability cases in recent history. The company approached the litigation by settling the most serious cases, and so far, Bayer has settled 2,312 Baycol cases for $872 million. Still, there are 9,278 Baycol cases pending. The Defense Department has also asked for Baycol documents, and shareholder suits seeking compensation for the damage the Baycol recall had on its stock prices are still being faced.
