Under the system of tort or personal injury law, a person who has suffered injury as a result of a defective drug has the legal right to seek compensation for their damages from the product manufacturer. The class action Zyprexa lawsuit was filed on April 16, 2004, in the U.S. District court for the Eastern District of New York. This class action Zyprexa lawsuit seeks compensatory relief for individuals who have been injured and medical examinations for Zyprexa users who have not suffered injury to enable the early detection and treatment of possible Zyprexa injuries. The primary injuries that were suffered by the plaintiffs in this class action Zyprexa lawsuit include diabetes, hyperglycemia, and pancreatitis.
Zyprexa lawsuits may be an appropriate method of seeking compensation for injuries that have been largely ignored by the maker's of this atypical antipsychotic prescription drug. Information about Zyprexa's potential side effects has been available for many years. Pre-marketing clinical trials indicated one out of 145 patients died as a result of Zyprexa use. This information was available to the pharmaceutical company and the FDA before this drug was approved but was not available to patients and medical professionals.
In 2002, Duke University issued a press release regarding government information about Zyprexa dangers. This study indicated 289 cases of diabetes that were caused by Zyprexa use. Of these Zyprexa victims, one hundred also suffered ketoacidosis, a serious complication of diabetes which can lead to coma or death. Another 22 patients also suffered from pancreatitis, which is also a life threatening condition. Twenty-three people in the study actually died as a result of Zyprexa side effects, including a fifteen year old patient who died of necrotizing pancreatitis.
This press release and other evidence of serious Zyprexa side effects prompted the federal government to request that Eli Lilly add stronger warning information about the threat of side effects to Zyprexa labeling. Unfortunately, warning labels do nothing to actually protect patients from suffering serious side effects as a result of defective drug use.
